Fellowship is a content sharing platform that enables creators to gather their audiences like a newsletter, but adding a social and interactive flux of content and a place for the user to keep it's subscribing.

The platform plays both the role of the gathering system (collective emails) and the displayer of contents (on the app and by emails).

Welcome to Fellowship!

We can't describe how happy we are to have you there ! By using Fellowship , you're helping creators to have a better control on their community. Our dream is to help every creators who suffered from invisibility on social media or lost their followers due to others' social media policies.

Fellowship tries to conjugue the best of the Newsletter system (mailing list) and social channels (interactivity). Newsletter first, because it's the best system to really stay in touch with your community and that you are truly getting something : emails of your prospects. Social channels then, because emails are old and non-interactive, which is pretty sad.

In that way, Fellowship is not a prospecting tool (to become more famous), but a validation tool, to stay in touch with your community. For ever. Well, as long as they want, of course.

Because of that, Fellowship is like a UFO App. Not really the usual thing. It was created by creators, for creators. Let's begin !

About these Terms

The Terms (and the policities we refer to in this document) apply to your use of our website (https://flw.sh/), apps and any other software for features provided in connection with our services. We will refer to it as "the platform" or "the app" of "Fellowship". When we say "we", "our" or "us" in the Terms, we're referring to Fellowship as a brand or an app, which is for now developed by a collective of creators. The founder asked for anonymity into these terms, but is the legal representative in its own name of the brand and the software, according to the law of its country (France), invoking his rights to privacy.

Please read these terms carefully and reach out if your have any questions about. If you don't agree, please, just don't use Fellowship.

Your Account

There's two "entities" on Fellowship. The Personal account and the Channel (or page).

You can have only 1 Personal account, linked to your mail address. You can have as many Channels as you want, through your personal account. You can be anonymous (Your personal account is not displayed on your channel).

Creators have 1 Personal account which gathers it's channels. Followers who are not creators just have a personal account, and no channel. Those kinds of users can create a channel and become a creator any time they want.

To create an account and become a Fellowship user, you must be at least 18. If you create an account for someone else, you must have their permission. You're responsible for your account and using it in a lawful way.

When you create an account, you agree to comply for these Terms and that you're over 18 and legally able to enter there Terms with us.

If you're using Fellowship on behalf of a business you agree that you have the right to do so.

You are fully responsible for what you are doing with your account, and the channels you are the founder with.

You must not assign or transfer your account to someone else, or use your account in a way which in our reasonable opinion, causes damage to Fellowship, our reputation, or infringes another's rights or applicable laws and regulations of the country in which Fellowship servers are based. (Right now: France)

Of course, despite the law, you are encouraged to be polite and gentle in every content displayed with your account. Fellowship keeps its right to delete any content which is bad for it's reputation or which is condemned by law.

Getting emails

Like a Newsletter system, your channel has a "Cover page". It's the page on which you will convince people to follow you, and it displays avatar, description and secondary links. If the visitor doesn't have any Fellowship account, it will display to him/her a mail input to subscribe to you, and Fellowship by the same occasion. If the visitor already has a Fellowship account, it will display a button to subscribe in one click, and your channel will be added to its subscription manager.

Every person who subscribes for the first time, will get a fellowship account, and must accept these terms (which are joined to the email of confirmation, according to the law). If he doesn't want that, he can totally unsubscribe and delete the account freshly created just after. He will no longer be following you.

How Fellowship use emails

Fellowship collects emails for you (the creators of channels).

The creator is the only responsible of its mailing list, and never Fellowship could be attacked or accused for a misused or bad use of a list of emails collected by a channel. The creator is 100% responsible of this list, which can be exported freely, as in others mailing list systems.

In exchange, Fellowship will never use those emails outside its own borders (website, app, derived tools).

Fellowship has the right to delete an email on purpose, which will disappear from every list of channels. Anyone can mail Fellowship to have its email deleted from all its subscribed channels.

But it's easier to delete the account from the website or just to unsubscribe from the channels you don't want anymore.

Fellowship declines all responsibility if the email is exported by a channel, in which case we can't do anything. Just like every usual mailing list.

Fellowship is only responsible for the stocking of the emails on its own part.

Every new email added on fellowship is, by default, subscribed to the Fellowship Official channel. He (the user) can totally unsubscribe anytime.

Fellowship will use emails to send technical emails (Log in, notifications), promotions emails about fellowships and its products, and the one-day email which generates a flux of news contents right into the mailbox.

Your Username

The username you choose must be appropriate for everyone and cannot infringe someone else's rights.

The username is linked to your email. It's displayed when you interact with content or channels : subscribing, commenting, liking, sharing…

It can be changed easily from your parameters.

You can't have a username which is offensive, vulgar or obscene.

You can't "reserve" a username. Two emails can have the same username.

If any of these issues occur over your username, we'll consider the circumstances reasonably and may require you to change it. If you refuse, we may suspend or cancel your account.

Your Channels

Your channels are the way you are sharing content with other people. Fellowship channels are used like a message-app channel, from bottom to top.

Its name is not unique, only its identifier is. The identifier is the name just after flw.sh/ on the adresse bar of your browser.

The identifier is unique.

You can't use a name or an identifier which is offensive, vulgar or obscene.

You can't "reserve" an identifier. Two channels can not have the same identifiers.

If you are using an identifier to steal or use the reputation of someone, that person will have the right to sue you. Same apply for the name of your channel.

If you are not using your channel (more than 6 months of inactivity from you or your community), we keep the right to suspend it. But never without contacting you first.

Your contents - what is allowed and what is not

Fellowship is a place of freedom of speech. Which means you can speak of what you want on your channel, but facing the law. We are also forbiding explicit legal pornographic contents right now, for the reason we don't have any minor protection yet. Of course, all illegal contents are totally forbidden.

The whole app is created as a "compartmentalized" place. Which means, you don't have access to other channels if you don't have their link or QRcode or identifier.

This construction helps people to feel more "home" on Fellowship. We want to create a feeling of "intimacy" that we don't have on usual social media. Joining a Fellowship channel is joining a community, and universe, an atmosphere. You are the one who decides which channels you want to follow and which you don't want.

We want to empower creators all around the world, but some things which could seem legal depending on their form, are not allowed on Fellowship, for obvious reasons. Here's the list :

  • Legal pornographics contents.
    • Content you're linking to
    • Avatar, banner.
    • Secondary links or name
  • Hate speech that encourages to harm someone or a community physically or mentaly.
  • Spam and fraud
  • Harassment on individuals or group
  • Self-Harm (promoting suicide, self-mutilation, disorderered eating and other harmful actions on the body like using chirurgical action and medical drugs which are not backed by solid science and proofs to be harmless or totally reversable)
  • Shocking or violent content
  • Misinformations. That part is tricky, and we just encourage you to honestly think about what you are sharing. Is it honest ? Is it something which seems true ? Or is it something to manipulate people ? You choose, but be careful. On the internet, there's a lot of lies, and not alway from where you think.

What is "My content" ?

When we talk about Your Content, we talk about all images, text, videos, links and other materials you add to your channel for your community to discover it OR you publish on others channels or part of the platform. You're 100% responsible for your content and you warrant that :

  • It's yours and if you're using third party content, you have the rights to share them.
  • None of your content will violate the privacy, publicity, IP or other rights of anyone else.
  • Your content will not be misleading or designed to manipulate your followers or other people.
  • Your content doesn't not contain any viruses or harmful code, files or programs.
  • Your content comply with these terms.
  • Tour contents doesn't contain of others people (pictures, creations) on which you have no rights or approbations to share.

Fellowship is right now established in France, and will respect the law of the country.

Every channel admin has the right to delete or hide contents from his channel, without an explanation to you.

Your contents - what we can do with it

We want to help you. But it doesn't mean we will have the rights to your content. Fellowship totally protects creators and respects intellectual properties. When you publish content, you just give us the right to display, use and share it. But it will always be your content, if you are the actual creator of them.

You grant us a license to use, publicly display, distribute, modify, adapt and create derivative works of such content.

This license is worldwide, royalty-free and perpetual, which means we can use your content anywhere in the world, without paying you fees, for as long as we like - unless you remove your content from the platform. However, you agree that you have all third party rights necessary to post the content on Fellowship and to grant us this license.

Don't be afraid : we will not use your content for getting more famous or other things l'île that, without asking you personally in private for a professional collaboration. All those terms just allow us to work with your content freely into the website and app, without enfraining any intellectual properties.

Don't forget that people can re-share your published content, and we can't do anything about it.

Please, don't share personal information that you don't want visible to the world. No security numbers, no password, no financial advice, no passport, no bank account…

The platform

We (the company) own the platforme. But we give you a limited right to use it for sharing content, collecting emails, gathering communities and interacting with other user's content. We're not responsible for any content, products or services made available with other user's profiles.

All rights of the brand and the domain will stay exclusively owned by Fellowship as a product exploited by the company. It includes our brand name and logo, which you can share but not modify, change or re-use in a way which can be harmful to our reputation or in any other way.

As a user, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Platform to create, display, use, play, and upload content in accordance with these Terms. If we provide you with any images, icons, videos, graphics, or other content, you must only use them on your profile and comply with any guidelines we make available to you.

You must not remove or alter any proprietary notices or trademarks on the Platform, or make unauthorized copies of, reproduce, distribute, license, sell, resell, modify, translate, disassemble, decompile, decrypt, reverse engineer, create any derivative works from, or attempt to derive the source code of, the Platform or any part of it.

To the extent allowed by law, we're not responsible for any opinions, advice, statements, products, services, offers or other content posted by other users on their channels.

Your plan

You can subscribe, for a channel, a free plan or a paid plan. Each channel created will be on Free Plan. Free plan will ALWAYS be accessible.

You can cancel your paid plan at any time, unless the contract say otherwise. (Exemple: if you paid for a whole year at one time).

Payments are not refundable. But we know that sometimes you requirements may change. You have 72h to tell us after paying for a paid plan, and we may make an exception.

All subscription fees will be billed in advance on a recurring basis, based on your chosen billing cycle (either monthly or annual). Your paid plan will automatically renew under these Terms (as updated at the time of the renewal) at the end of your billing cycle unless you've canceled your plan.

You must provide a valid payment method (i.e. credit card) and accurate billing information when you join. In doing so, you authorize us to charge all fees to such payment methods. If automatic billing fails, we'll issue you an online invoice, which you must pay within the time indicated.

You agree that if we charge transaction fees, they will be deducted from the proceeds of your transaction prior to receipt. You're responsible for paying any external fees and taxes (including withholding taxes) if they apply, and income taxes, associated with payments you receive through the Platform.

Deleting my account

According to RGPD law, you can ask us to delete anything we have on you : channels or personal accounts. Take in consideration that you can also delete them through the website by yourself.

Privacy & data

We care about your privacy and your community privacy

Your datas (personal account and channels) are hosted on OVH servers, in France.

Comportements or measures made of the users on the platform are owned by us. We make no representations or warranties as to the accuracy or completeness of the Data Analytics, but we'll try to make it as accurate and complete as we can.

Confidentiality

If we share any confidential information about us or the Platform with you, you must keep it secret and secure.

From time to time, we may share info with you that is confidential (e.g. we may reveal new and upcoming features to you if you take part in alpha or beta testing with us). You must keep this info secret and secure and use reasonable measures to prevent others from accessing it.

Feedback

We love hearing your ideas to improve Fellowship. Keep in mind that if you share feedback with us or suggestions, we're free to use it however we like, without payment or reward to you. (Or to not use it all, that doesn't mean we don't like you). We are constantly evaluating and improving the platform.

And it's a tough job.

Bugs and problems on the platform

Fellowship is a young app in ALPHA public. That means that everything is supposed to work well. Supposed. We are working hard on improving and fixing every bad thing or bug. Be patient. Be tolerant. Be gentle. And don't blame us too hard.

You can't accuse us for a bug, or sue us for it. We are not legally responsible for lost contents, lost of emails, or other things which are bad for you or your interest, individually or for a company, brand or other moral entities. Even if the bug is due to an error from us.

  • We are not liable for any damages suffered as a result of downloading, installing, or using the Platform, or copying, distributing, or downloading any content from the Platform. You have sole responsibility for the adequate protection and backup of your data, content, and devices used in connection with the Platform.
  • You will indemnify us against any loss arising out of a breach by you of these Terms, or a third party claim made against us in relation to your content.
  • Neither of us will be liable for any indirect, punitive, special, incidental or consequential damage (including loss of business, revenue, profits, use, privacy, data, goodwill or other economic advantage), whether for breach of contract, in tort (including negligence) or otherwise, even if we know such damage is possible.

Fellowship does not make any express or implied warranties or representations that:

  • the Platform will function uninterrupted, securely or be available at any time or place;
  • any errors or defects will be corrected;
  • the Platform is free of viruses or other harmful components;
  • the Platform is effective or the results of using the Platform will meet your needs
  • any content on the Platform (including any user content) is complete, accurate, reliable, suitable or available for any purpose.

Open Source

The app contains open source software.

Certain open source software components are subject to their own applicable license terms. To the extent that any such license terms do not permit the relevant open source component to be licensed to you under these Terms, these Terms will not apply to that component, and your rights and obligations in respect of that component will be governed by the applicable license terms.

Responsibility of the platform.

Fellowship owns no responsibility over your use of the platform or any kind of bad things Fellowship will get you. You're a grown up (as we said you need to be over 18 to open an account), and you understand that the internet can be messy sometimes with procedural users. We're honest creators trying to give you an honest and beautiful platform. If you are not happy, we apologize, but we're protecting ourselves by letting you know that we are not responsible for anything which happens to you with the platform.

We are only responsible for the emails collected (for Fellowship, not for your channel in particular), and we transfert the security of the hosting responsibility to OVH, as the main host.

Of course, we assure you we are doing our best for the security of our datas, and we will always discuss with you to find a solution to any problems. We're actual humans behind a computer. Just like you.

Fellowship, as a brand and a software, is not the property of a multinational company nor a sub-GAFAM product. Its legal entity will evolve over time.

Changes

Fellowship is constantly evolving and improving. We may make changes to the Platform or these Terms. If the change will have a significant negative impact on you, we'll notify you beforehand.

We may need to change these Terms from time-to-time to reflect business updates, changes to the Platform (including if we decide to discontinue any functionality, features or part of the Platform), legal or commercial reasons, or otherwise to protect our legitimate interests.

We can make these changes at any time and it's your responsibility to check these Terms now and then for any changes. However, if a change will have a material negative effect on you, we'll use our best efforts to notify you via our own Fellowship channel (flw.sh/fellowship)

Your continued use of the Platform after any changes to the Terms is taken as your acceptance of the revised Terms. If you don't agree with the changes, we ask you to stop using Fellowship and cancel your account.

Last but not least

Few more things you have to know before you can use Fellowship.

Laws may apply to you or us as a result of your specific location. If this is the case, and if those laws are inconsistent with any part of these Terms, those laws will take precedence to the extent of the inconsistency if you are claiming your nationality on your channel or your profile. If not, you will be subject to French law.

These Terms make up the entire agreement between you and us in connection with the Platform. No other term is to be included, except where required by law. All implied terms except those implied by statute which cannot be excluded are expressly excluded.

If any provision of these Terms is invalid under the law of any country, these actual terms will continue to apply, unless this is under French law.

These Terms are governed by the laws of the French Republic. Both you , as a user, and we, as the company, submit to the exclusive jurisdiction of the courts of those jurisdictions.

Our failure to insist upon or enforce any provision of these Terms will not be considered a waiver of any provision or right. Neither these Terms, nor the Platform, create a relationship of agent / principal between you and us.
